Judicial report: Weather: Overcast A charge against RD BLACBURN under Rules 64.2 and 64.5 adjourned at Otago on 9 October 2008 was reconvened. BLACKBURN elected to plead guilty to the charge and in explanation stated that she had in an earlier conversation with the Otago Secretary on another matter mentioned MUNGO being the 2nd reserve but had not formally scratched it at that time in accordance with the Rule. She submitted in writing reason why MUNGO should not be stood down. The Adjudicating Steward imposed a fine of $50.00 with no stand down being applied.
A further charge under Rules 82.5 and 88.1.a. was laid against RD BLACKBURN in respect of BIBI DAHL, a starter at Otago on 9 October 2008. That charge related to an application under Rule 82.5 which was made at the time of kennelling. She elected to plead not guilty to the charge. The circumstances were that BIBI DAHL was subject to a 10 day stand down at Christchurch on 7 October under Rule 82.1. She stated that the dog was sound the next day so was fit to race. That was confirmed by the examination at Otago on 9 October 2008 by veterinarian T MALTHUS. The dog was permitted to start.
It was submitted by the Steward in Charge that the application by BLACKBURN needed to have been made prior to the 7.30am scratching time on race day and not at the time of kennelling. The Adjudicating Steward dismissed the charge on the basis that there was nothing in Rule 82.5 that clearly stated when the application must be made.
Further inquiries are being conducted into the circumstances of BAXTERS LAD being nominated and entered in a C4 295 metre event , when already qualified for the Platinum Paws semi finals.
