Health and Safety comment:

Judicial report: Weather: Overcast A 15 minute delay to the start time of Race 12 occurred due to a broken wire in the lure carriage necessitating the carriage to be replaced and tested prior to the start of the race. Race 13 was also rescheduled to suit TAB Trackside requirements.
Trainers are reminded of Rule 326 which requires that all periods of suspension and incapacitation must be entered on the race record card by the Stipendiary Steward or Judicial Steward on the day. The Owner or Trainer shall be responsible to ensure the suspension or incapacitation period is adhered to. This requires that when a suspension, scratching or stand down due to injury during a race occurs, that where possible, the Trainer makes every endeavour to ensure that the applicable endorsement is made on the race record card prior to leaving the track. Your co-operation is sought as it is not the responsibility of the Stipendiary Steward to pursue the presentation of these documents.
The AGRC Judicial Committee( Messrs N.Mc Gough and B.McGhie), heard an application from trainers' G.Calverley and S.Clark to consider the eligibility to compete and possible disqualification of the greyhound 'Farmer Benson' from Race 4 at today's race meeting. The applicants disputed the current NZGRA grading of the greyhound as a C1 and in their opinion it should be a C2.
Following consideration of all evidence presented by the interested parties and the relevant NZGRA rules the Committee dismissed the application for disqualification on the basis that it would be a breach of natural justice as the trainers (B & L Craik) had no option but to obey the grading decision of the NZGRA.
The Judicial Committee also stated that ; Accordingly it is the decision of the Committee that the proper interpretation of the relevant Rules and in particular the intention of the exception in Rule 208, be referred to a higher Authority within the NZGRA. ( for example the Rules Committee or an appointed NZGRA Judicial Committee) to take legal advice, permit submissions from interested parties and determine the question for the future as a matter of urgency.
SUBSEQUENT.
Following the completion of Race 4 which the greyhound in question Farmer Benson won, trainer S.Clark lodged a formal objection under Rule 316.5.
The Judicial Committee considered that as it had already ruled on this question, it could not reconsider the matter, and accordingly referred the objection to the Committee of the AGRC in accordance with the provisions of Rule 140.
